Organizational Models and Codes of Conduct for preventing and combating abuse, discrimination and violence in the sport environment

This paper analyses the impact of Legislative Decree No. 39/2021 on the regulation of the sports sector, with a focus on Organizational Models, Affiliation Body Guidelines, and Codes of Conduct. The legislation aims to promote gender equality, protect minors, and prevent discrimination and abuse through the adoption of regulatory and organizational tools. Among the most relevant measures is the obligation for sports clubs and associations to adopt Organizational Models and to appoint key figures such as the Safeguarding Officer and the Officer Responsible for Preventing Abuse, Violence, and Discrimination, who are tasked with overseeing the implementation of safeguarding policies. In this context, the paper proposes a methodology for constructing Organizational Models, drawing on best practices from other sectors, particularly those related to the liability of entities under Legislative Decree No. 231/2001.
