Brevi considerazioni sulle norme relative all’inclusione delle persone disabili in università alla luce dei Disability Studies

The author intends to critically review national laws concerning the inclusion of disabled students within the academic system in light of the new approach arising from the UN 2006 Convention. To evaluate the system we will use the social model of disability, as its conceptual framework is able to highlight the structural factors, embodied in current provisions, which generate the exclusion of disabled students. After a brief introduction on Disability Studies, followed by a focus on the relationship between law and studies on disability, domestic laws on the matter will described; lastly, national laws will be compared to the United Nations Convention in order to verify the compliance of the whole system with the new paradigm emerging from the CRPD. Attention will be given to the behavioural factors and obstacles, which, while formally respecting laws, are still generating the exclusion of disabled people within universities.
