The sustainability of fundamental rights in relation to available economic resources

This paper addresses the current problem of the legal sustainability of the modern welfare state system. The economic crisis does not make it possible to universally guarantee public interventions, especially in the social sphere, without any limitations, just as it once did. Therefore, a problem of balancing economic-financial needs and protection of fundamental rights exercisable within the welfare systems has emerged. The contribution deals with the difficult search for an acceptable balance on behalf of the legal systems to meet the need for the sustainability of fundamental rights in relation to available economic resources. Future prospects for reflection and action are outlined regarding the issue of the sustainability of fundamental rights in conditions where availability of economic resources lacks.
